Terms of Service

These Terms of Service (“Terms”) govern your use of the Taesty applications, website, and related services (“Taesty” or the “Service”).

Taesty is provided by Sumosmash UG (haftungsbeschränkt), Seydelstr. 12, 10117 Berlin, Germany (“we”, “us”, or “Taesty”).

By downloading, installing, accessing, or using Taesty, you agree to these Terms.

If you do not agree to these Terms, please do not use Taesty.

1. What Taesty does

Taesty helps you organize, understand, search, and retrieve screenshots and other visual content.

Depending on the platform and version of Taesty you use, features may include:

  • importing or accessing screenshots and images;
  • optical character recognition (OCR);
  • visual and semantic analysis;
  • automatic classification and tagging;
  • natural-language search;
  • AI-generated descriptions or metadata;
  • synchronization between your Apple devices, where available (Taesty memory sync is planned and is not enabled in the current app);
  • integrations that allow other applications or AI agents to interact with your Taesty library.

Taesty is currently designed primarily for Apple platforms, including iPhone and Mac. Supported devices are listed with the applicable app version.

The exact features available may vary by device, operating system, subscription plan, region, and product version.

2. Your content belongs to you

You retain all rights to screenshots, images, text, metadata, files, and other content that you use with Taesty (“Your Content”).

Using Taesty does not transfer ownership of Your Content to us.

You give Taesty only the limited rights technically necessary to process Your Content in order to provide features that you request, such as indexing, searching, syncing, or displaying it.

We do not claim ownership of Your Content.

3. Local processing and Apple services

Taesty is designed so that core processing, including analysis and indexing of screenshots, can take place on your device.

Apple services such as iCloud Photos and device backups may store, synchronize, or restore information according to your settings. Taesty-specific memory synchronization through CloudKit is planned but is not enabled in the current app.

Your use of iCloud, CloudKit, the App Store, and other Apple services is also subject to Apple’s applicable terms and privacy policies.

Taesty does not require you to create a separate Taesty user account.

Certain features may nevertheless depend on your Apple ID, iCloud configuration, device permissions, or other platform services.

Disabling iCloud, removing permissions, signing out of your Apple ID, changing devices, or modifying operating-system settings may cause some Taesty features to stop working or may make previously synchronized information unavailable.

4. Taesty is not a backup service

Taesty is primarily an organization, indexing, and retrieval tool.

You should not rely on Taesty as the sole backup of important screenshots, images, documents, or other information.

You are responsible for maintaining appropriate backups of information that is important to you.

Although Taesty may use iCloud, CloudKit, local storage, or similar technology, synchronization should not be understood as a guarantee that data can always be recovered.

5. AI, OCR, search, and generated metadata

Taesty may use machine-learning or AI systems to analyze images, recognize text, generate descriptions, classify content, create metadata, and interpret natural-language searches.

These systems are probabilistic.

Results may be incomplete, inaccurate, outdated, or incorrectly matched to your query.

For example, Taesty may:

  • fail to recognize text contained in an image;
  • assign an incorrect category or description;
  • fail to return a relevant screenshot;
  • return an unrelated screenshot;
  • incorrectly interpret the meaning or context of an image.

You should not treat Taesty’s classifications, search results, generated descriptions, or other automated outputs as authoritative information.

Taesty is not designed to provide legal, financial, medical, safety-critical, or other professional advice.

6. Connections to third-party services and AI agents

Taesty may allow you to connect your library to third-party applications, tools, AI systems, or agents.

This may include integrations using protocols such as MCP (Model Context Protocol).

These integrations are optional and require you to enable or authorize them.

When you connect Taesty to a third-party service, information requested through that integration may be transmitted to that service.

Once information is transmitted to a third party, that party’s own terms, privacy practices, security measures, and data-handling rules apply.

Taesty is not responsible for how third-party services process information that you intentionally make available to them.

You should only connect services that you trust.

Taesty’s MCP connection runs through a local server on your Mac. Requested images, text, and metadata can become available to the connected agent and may be sent to the provider running its model. Disconnecting the integration stops future requests; it does not retract information already received by that provider.

7. Acceptable use

You may use Taesty for personal and lawful professional purposes.

You may not:

  • use Taesty in violation of applicable law;
  • interfere with or attempt to disrupt the Service;
  • attempt to gain unauthorized access to Taesty systems or infrastructure;
  • bypass technical usage limitations, subscription restrictions, security measures, or access controls;
  • reverse engineer Taesty except where applicable law expressly permits it;
  • use automated systems in a manner that materially harms the Service or other users;
  • use Taesty to distribute malware or conduct attacks against other systems;
  • use Taesty in a way that infringes the intellectual-property or privacy rights of others.

You are responsible for ensuring that you have the right to process content that you import into or access through Taesty.

9. App Store purchases and subscriptions

Where a purchase or subscription is made through Apple’s App Store, the payment is processed by Apple.

Billing, renewal, cancellation, refund eligibility, and management of the subscription may therefore be governed by Apple’s applicable terms and the settings associated with your Apple account.

Recurring subscriptions continue for the period displayed when you subscribe unless they are cancelled in accordance with the applicable App Store rules.

Taesty does not directly receive or store your full payment-card information for App Store purchases.

10. Changes to paid plans and pricing

We may introduce new plans, change prices, or change the features included in future purchases or subscription periods.

Changes to an existing paid subscription will be handled in accordance with applicable law and the rules of the platform through which you purchased it.

Where applicable law requires advance notice, consent, or a termination right before a material change takes effect, we will provide it.

11. Updates and changes to Taesty

Taesty will evolve over time.

We may add, improve, replace, or discontinue features where reasonably necessary, for example because of:

  • technical developments;
  • changes to operating systems or platform APIs;
  • security requirements;
  • legal or regulatory requirements;
  • third-party dependencies;
  • product improvements;
  • low use of a feature.

Changes to digital products supplied to consumers will be made subject to mandatory consumer-protection law.

Where required, we will provide information about material changes and applicable rights.

We may also provide updates, including security updates, that are necessary for Taesty to continue functioning correctly.

You may need to install operating-system or application updates to continue using some features.

12. Intellectual property

Taesty, including its software, design, branding, interfaces, graphics, documentation, and underlying technology, is protected by intellectual-property laws.

Except for Your Content and third-party materials, all rights in Taesty remain with us or our licensors.

These Terms give you a personal, limited, non-exclusive, non-transferable right to use Taesty in accordance with these Terms.

They do not transfer ownership of Taesty or its technology to you.

Open-source components used by Taesty remain subject to their respective open-source licences.

13. Apple licence terms

If you download Taesty through Apple’s App Store, Apple’s applicable standard end-user licence agreement may also apply to your use of the application.

Where these Terms concern the Taesty service and Apple’s terms concern your licence to the application distributed through the App Store, both may apply.

Nothing in these Terms is intended to reduce rights that Apple or applicable law requires us to provide to you.

14. Availability

We aim to keep Taesty reliable, but we cannot guarantee uninterrupted or error-free availability.

The Service may occasionally be unavailable because of maintenance, device limitations, software bugs, Apple services, network interruptions, third-party infrastructure, operating-system changes, or circumstances outside our reasonable control.

Functionality that depends entirely on your device may also be affected by the available storage, memory, hardware, permissions, or operating-system version.

15. Third-party services

Taesty may interact with or depend on third-party services, software, models, frameworks, or operating-system functionality.

We are not responsible for services operated by third parties.

Third-party providers may change or discontinue their services, APIs, software, or terms independently of Taesty.

Where that affects Taesty, we may need to modify or discontinue the corresponding functionality.

16. Ending your use of Taesty

You may stop using Taesty at any time.

You may uninstall the application and, where applicable, cancel a subscription through the platform through which it was purchased.

Deleting Taesty from a device may not automatically delete data stored through iCloud or other Apple services.

On Mac, moving the app to the Trash alone may leave local app data behind. “Remove from memory” currently hides an item while retaining its local record; it does not erase all indexed information. See Retention and deletion for details.

We may restrict or terminate access to parts of the Service if reasonably necessary because of serious misuse, security risks, non-payment, violation of these Terms, or legal requirements.

Mandatory consumer rights remain unaffected.

17. Warranty and statutory rights

If you are a consumer, you have statutory rights relating to digital products and services.

Nothing in these Terms excludes or limits rights that cannot legally be excluded or limited.

In particular, applicable statutory rights relating to conformity, defects, updates, and remedies for digital products remain unaffected.

18. Liability

We are liable without limitation where liability is required by law, including for:

  • intentional misconduct or gross negligence;
  • injury to life, body, or health caused by negligence;
  • liability under mandatory product-liability law;
  • guarantees expressly given by us;
  • other liability that cannot legally be excluded or limited.

In cases of ordinary negligence, we are liable for breaches of essential contractual obligations where fulfilment of those obligations is necessary for the proper performance of the contract and you may normally rely on their fulfilment.

In such cases, liability is limited to damage that was reasonably foreseeable when the contract was entered into.

To the extent permitted by applicable law, we are not liable for damage resulting solely from inaccurate AI-generated classifications, search results, OCR outputs, tags, or other automated analysis where the Service otherwise operated as agreed.

You remain responsible for maintaining appropriate backups of important information.

The above limitations do not affect mandatory consumer rights.

19. Privacy

Our handling of personal data is described separately in our Privacy Policy.

These Terms and the Privacy Policy serve different purposes. The Privacy Policy explains how data is handled; these Terms govern your contractual use of Taesty.

20. Changes to these Terms

We may update these Terms where reasonably necessary, for example because of changes to Taesty, applicable law, business models, or third-party services.

If a change materially affects an existing contractual relationship, we will provide notice where required by law.

Changes will not retroactively remove rights that you already have.

The date at the top of these Terms indicates the most recent version.

21. Consumers in the European Union

If you are a consumer residing in the European Union or European Economic Area, mandatory consumer protections applicable in your country remain unaffected by these Terms.

Nothing in these Terms is intended to waive statutory rights that cannot legally be waived.

22. Consumer dispute resolution

We are neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.

23. Governing law

These Terms are governed by the laws of the Federal Republic of Germany.

If you are a consumer, this choice of law does not deprive you of mandatory protections provided by the law of the country in which you have your habitual residence.

Any mandatory rules concerning jurisdiction remain unaffected.

24. Severability

If any provision of these Terms is invalid or unenforceable, the remaining provisions remain unaffected.

The invalid provision will be replaced by the applicable statutory rule to the extent required by law.
